VEHICLE RENTAL AGREEMENT
 

WARRANTIES and IMDEMNITIES

The lessor & the renter both accept this offer and undertake to comply the contractual provisions as stated below and with which they both agree. Both parties warrant that they have the necessary power and approval to enter into this car rental agreement. Both parties warrant that they are not aware of anything in their reasonable control which will or could have an adverse upon their liability to perform their respective obligations under this car rental agreement. The renter undertakes to pay all rental rates, administration charges, fuel charges, CVA charges, contravention charges & for damages to the lessor promptly and not to unreasonably withhold payment.

The lessor has the right to collect the Rental Car after 48 hours of expiration of the car rental agreement if the renter refuses to return the car. The renter is offered a gratitude of 60 minutes over and above the drop-off time noted on the rental agreement, after which a payment for 1 extra day plus fees for insurance & extras must be made. Extra expenses incurred for the collection of the vehicle will be borne solely by the renter. The renter is obliged to pay €50.00 for each day or part thereof as a penalty charge until the date of collection by the lessor.

The minimum rental is 1 day (24hrs) & any driver of the car must be between 23 & 75 years old. Driver(s) aged between 23 & 24 years require a minimum of 12 months driving experience and a Young Driver Surcharge of €15.00 per day must be paid.
All rates are in ‘€’ currency & include VAT (18%) as per Maltese regulations. All rental cars are offered with unlimited kilometres.

1. WHAT DOCUMENTS DO I NEED TO PRODUCE?
If you are hiring as a private individual, you must provide us with:
» Your first name, surname and residential address by means of your valid driving license and a valid identity card/passport.
» A valid credit card which will be used to pre-authorize the total deposit amount.

2. WHAT AM I HIRING?
The vehicle which is provided to you under this agreement is described in the ‘vehicle’ section. Before taking charge of the vehicle, together with the agent you must take any sort of pictures or videos of dents, scratches or any other form of damage, if any are found on the vehicle. When returning the car, if any damage is pointed out and you as a renter don’t have any picture proof that the damage was not there upon taking control of the car, you will automatically be responsible to pay for such unless covered by any of our insurance options or extras.

The Lessor is obliged to provide vehicles in good mechanical & working order. However, you may test drive the vehicle over a distance of 3 kilometres, after which the vehicle will be considered fit for the use and free from mechanical faults.

3. WHAT MAY THE RENTED VEHICLE BE USED FOR?
The rented vehicle is for your private use and is not transferable, but you may authorise one or more additional drivers who must be approved & authorised in writing by the lessor on this contract. You undertake to drive carefully and to respect the Maltese highway code. You also undertake not to use the vehicle:

» For the carriage of the passengers for hire or reward whatever the means of payment used and whatever the written or verbal agreement.
» To propel or tow any other vehicle or trailer or any other object with or without wheels.
» In any competition.
» For unlawful purposes.
» For driving tuition.

You undertake to keep the rented vehicle closed and locked when unattended and to keep the keys, which must under no circumstances be left in the vehicle. If the car is stolen due to the fact that the keys where left inside, outside or very close to the car, the renter must pay to the lessor the total value of the car according to an expert’s report on the market value of the said car.

You must under no circumstances transfer, sell, mortgage or pledge this contract, the vehicle, its accessories/tools or treat them in any way that might cause harm to the lessor or to third parties. You also undertake not to modify or add any accessories to the rented vehicle.

4. WHO MAY DRIVE THE CAR?
Any driver(s) aged between 23 & 75 years old that is named on the rental agreement. For driver(s) aged between 23 & 24 years a minimum of 12 months experience is required and a Young Driver Surcharge of €15 per day must be paid. Consequently, when the vehicle is driven by a driver who is not named on the contract, the renter has sole liability for all the costs resulting from any accidents/damages that may occur to the car or third-party property. Finally, an approved driver should remember that the renter has sole liability for the financial consequences of the use of the vehicle by an approved driver.

5. HOW AM I INSURED?
Only driver(s) named on the rental agreement and for the period stated therein are covered by the lessor’s motoring insurance policy for public liability covering damage to third parties, theft or attempted theft and damage to the rented vehicle.

The vehicle’s insurance policy is only valid within the Maltese Islands, and any use of the hired vehicle outside their geographical limits will be considered taking the vehicle without the owner`s consent by the renter who will be subject to the civil and criminal consequences resulting from this crime.

There are several options that can be paid extra for which cover different areas:
» You may pay €13 per day for Silver option which will reduce the total deposit amount to be pre-authorized to €800 and the damage/theft excess  at stake to €500.
» You may pay €28 per day for Gold option which will reduce the total deposit amount to be pre-authorized to €300 and the damage/theft excess  at stake to €0. This option also grants you Glass & Tire Protection (GTP) & Vehicle Theft Protection (VTP) for free.
» You may pay €5.00 per day for Personal Accident Coverage (PAC) which covers the passengers and driver of the rented vehicle, which provides a lump-sum benefit per person in the event of death or permanent disability resulting from a road accident involving the rented vehicle.
» You may pay €4.00 per day for Vehicle Theft Protection (VTP) which covers the rented vehicle or any of its accessories in the case that any of these are stolen.
» You may pay €2.50 per day for 24/7 Roadside Assistance (RA) which covers you in the case that you would require assistance with your car after a problem would have developed. If the problem is caused due to the renter’s fault such as a flat or burst tyre, drained battery after leaving the lights on, a collision where no third party is involved or where the renter is at fault or driving through water flooded roads and such cover is not paid for, there will be a charge of €85 for every time that a repair man/recovery truck is required. If the problem is caused due to mechanical failures or other instances that the lessor deems that the renter is not at fault, there will not be any repair man/recovery truck charges to pay.
» You may pay €3.50 per day for Glass & Tires Protection (GTP) which covers you in the case that any of the windows or windscreens of the rented vehicle are damaged and also in case that any of the 4 tires of the rented vehicle  are damaged. If the damage is deemed to be by negligence (Bursting a tire after driving through an un-paved road or breaking a window because you locked the keys inside the rented vehicle) you will not be covered by this insurance and will be liable to pay part or the full damage/theft excess.

In the event of an accident you may lose part or the full damage/theft excess. If a third party is involved, you will be held responsible and thus lose part or the full damage/theft excess until the insurer of the rental vehicle can conclude whose fault it is. If you are found to be part at fault or 100% not at fault you will be eventually be returned part or the full damage/theft excess.

6. WHEN AM I NOT INSURED?
You are not insured in the following cases:
» If you are unable to return to the lessor the original keys of the vehicle after it has been stolen. In this case you will be liable for payments of the market value of the vehicle as evaluated by an expert.
» When the damage to the vehicle is the result of burns, interior damage, overloading, poor judgement by the driver of the dimension of the vehicle in particular of the upper or lower parts of the vehicle, as well as damage to the tyres, hubcaps and wheel rims unless covered by extra insurance options.
» When the driver is under the influence of alcohol as defined by the Maltese highway code, or when the driver has consumed legal or illegal drugs/narcotics/stimulants, or when the driver has taken medicines whether or not they are medically prescribed whose side effects include loss of concentration or similar.
» When the damage to the vehicle occurs after the date the vehicle is due back as stated in this rental agreement, this case being equivalent to driving without the consent of the lessor and to theft of the vehicle.
» If any of the named driver(s) have given the lessor false information regarding your identity or the validity of your driving license.
» For damage or loss, of any kind whatsoever, to personal property, objects or animals being carried in the vehicle.
» When the damage is the result of wilful action of any of the named driver(s).
» When the vehicle is used for any of the mentioned reasons in part 3 of this agreement.
» When the vehicle is used in such manner that it is overloaded, by carrying more passengers or a heavier load than those dictated on the vehicle’s log book.

8. WHAT DO I DO IN CASE OF THEFT OR ACCIDENT?
Anyone of the named driver(s) should comply with these instructions:
» Report the theft or attempted theft of the rented vehicle to the police authorities or at the police station and to the Lessor as soon as possible as you become aware of it, and hand over the original keys of the vehicle to the Lessor.
» Inform the lessor immediately by calling our 24/7 customer care number +35699969798 of any road accident involving the rented vehicle and wait for any further instructions given. Eventually you will be asked to pass on any details, witnesses, forms, photos or any other information to the lessor

9. WHAT DO I HAVE TO PAY TO THE LESSOR?
There are 2 kinds of charges that will be individually displayed on the rental agreement:

Standard charges:
» The agreed tariff of the rented vehicle per day.
» The agreed tariff for pick-up & drop-off of the rented vehicle.
» The agreed tariff for insurance options or any other extras.

Additional charges:
» For any rented vehicle that is dropped-off with a lower level of fuel than when picked-up, a service charge of €25 applies over and above the fuel purchased to return the fuel level at the pick-up phase.
» For any contraventions that any of the named driver(s) earn whilst in possession of the rented vehicle, a service charge of €35 applies over and above the contravention amount.
» For any damages left on the rented vehicle unless covered by any of the insurance options for such.
» For any expert & legal fees paid in the event of a court case or an accident.
» For any repairs to be done in the case of mechanical issues which the lessor deems that the named driver(s) are at fault.
» Should the rented vehicle be parked wrongly or on a designated no-parking area provided that a permit is issued from the local council and the car would have to be towed away, a service charge of €250 applies.

RETURNS, REFUNDS & CANCELLATIONS:
Changes to reservations can only be made via writing whether by e-mail or by sms by not later than 96hrs prior to the rental date & time and are only in place if confirmed by the lessor by the same method of communication that the renter would have used.

» If the renter cancels the reservation within 96hrs prior to the rental date & time, no refund will be given and the lessor will demand that the reservation is paid in full. If the renter changes the reservation within 96hrs prior to the rental date & time, a service charge of €50 applies if the demands can be met otherwise the reservation won’t be changed.

» Early returns of the rented vehicle will not grant any refund on any of the paid funds for the original reservation.

DATA PRIVACY POLICY:
By entering into this rental agreement, you agree that we can process and store your personal information in connection with this agreement. We will use your information to analyse statistics, for market research, credit control and to protect our assets. You agree that if you break the terms of this agreement, we can pass your personal information to credit-reference agencies, debt collectors, the police or any other relevant organisation.

By signing this agreement, you confirm that you are in complete agreement with the terms & conditions listed above!

 

Payments & Deposits -

  • Credit Cards are accepted onboard every cab.
  • All prices displayed and quoted are inclusive of (18%) Value Added Tax.
  • Unless a client’s account is held with M Cabs Ltd., payment terms are strictly cash on delivery.
  • Any quoted fares may be subject to additional waiting charges.
  • Credit card charges will show as M Cabs Ltd. on your bank statement.

Cancellations & Refunds –

  • If a reservation is cancelled by the customer within 48 hours from the pickup time, M Cabs Ltd. has the right to charge 50% of the total quoted price as cancellation fee.
  • If a reservation is cancelled by the customer within 8 hours from the pickup time, M Cabs Ltd. has the right to charge 100% of the total quoted price as cancellation fee.
  • If the customer is not at the pickup point within 15 minutes of the pickup time, M Cabs Ltd. has the right to charge 100% of the total quoted price as cancellation fee.

Special Periods of Activity –

  • M Cabs Ltd. reserves the right to apply a surge charge to the prices quoted on our website for periods of exceptional activity & higher than usual demand for our services. These include but are not limited to: Christmas Eve, Christmas Day, New Year’s Eve, New Year’s Day & Easter Sunday.
  • Any bookings made for such days are to be fully pre-paid upon booking. Bookings are not considered as confirmed unless full pre-payment is received. Any reservations cancelled within 48 hours of the pickup time will lead to the prepayment to be consumed as cancellation fee.

Our Vehicles, Drivers & Passengers –

  • M Cabs Ltd. requires a minimum of 4 hours’ notice for online reservations. All reservations are not confirmed unless manually confirmed by any of the M Cabs Ltd. personnel.
  •  For any cab requests required within the next 24 hours kindly call us on +356 99 93 94 95 or send us a WhatsApp message on the same number.
  • Whilst we do our very best to be punctual also attending to reservations 5-10 minutes before the pickup time, when possible, we can’t accept responsibility for delays caused by circumstances beyond our control.
  • Our drivers will drive safely in accordance with the road conditions, traffic conditions and legal speed limits.
  • Customers are responsible for any damages and actions that will lead to the cab being put off the road till repaired/cleaned. Any expenses incurred to do so are to be paid in full by the customer.
  • M Cabs Ltd. reserves the right to provide a subcontracted vehicle & driver to a reservation.
  • Any information exchanged with M Cabs Ltd. personnel will STRICTLY be safeguarded from any third parties. We also guarantee that such contact information will not be used to share marketing information with you.
  •  If the client wishes to add any stops or change the route or destination than originally agreed, the quoted price at the time of reservation will not apply anymore and the customer must pay any extra fees as instructed by the driver.
  • M Cabs Ltd. reserves the right to change the vehicle or driver than those originally booked, if needed.
  • Our chauffeurs have strict orders to follow the route instructed by the GPS. The GPS will always show the fastest not the shortest route according to the traffic & road conditions at that very moment. Kindly let the driver decide which is the best route to follow.
  • All cabs attending to reservations whether property of M Cabs Ltd. or subcontracted vehicles are fully insured for passengers & third-party claims. M Cabs Ltd. & the insurer does not cover any damage/theft or loss of any personal belongings or valuables.
  • Our drivers usually go through the car after dropping off the customers to look out for any belongings left behind. Drivers are not responsible for any belongings left behind and will attend to these at their own free will. Unless belongings left behind are collected from our Main Depot, a fee applies to drive those belongings back to the customer. Lost items recovered from our car will be kept at our Main Depot for not more than 2 weeks, after that they will be disposed of.
  • Our drivers have the right to refuse any customers from boarding our cabs if the customers are showing signs of being under the influence of alcohol or drugs and showing dangerous or aggressive behaviour that could poses a threat to either the driver, the cab or the other passengers.
  • M Cabs Ltd. can supply a baby seat or a booster seat at an extra cost for any reservation. This requirement should be passed on to the member of staff upon booking the transfer as such seats are only available on request.
  • All of M Cabs Ltd. & subcontracted cabs carry a strict nonsmoking policy. E-cigarettes are also not allowed to be used whilst on board.
  • The rates quoted on our website are only for point-to-point basis. Any extra pickups/drop-offs or stops are subject to an extra fee as instructed by M Cabs Ltd.
  • M Cabs Ltd. reserves the right to charge an extra fee for waiting time as instructed by any staff member or the driver.
  • M Cabs Ltd. reserves the right to charge an extra fee for excessive luggage.

Airport Transfers –

  • Waiting time at the airport is 45 minutes after the actual landing time of the plane, after this time the driver will mark the trip as a no show.
  • The driver may wish to help the customer put the luggage in or take then luggage out from the car. Kindly note that the driver may refuse to help at his/her discretion.
  • When a flight is delayed, we shall monitor the flight for an updated arrival time and adjust the pickup time accordingly. In case of connecting flights kindly note that we are only obliged to follow the flight coming to Malta.
  •  For customers going to the airport, kindly ensure that you are at the pickup point at least 5 minutes prior to the booking time.
  • If a customer is unable to locate the driver, it is the customer’s responsibility to call us on +356 99 93 94 95 and we shall make immediate contact with the driver to solve the situation asap.
  • Any amendments to your reservation within 24 hours of the pickup time must be passed on to us through a phone call on +356 99 93 94 95.
  • Unless stated otherwise at the time of reservation, each customer is allowed 1 piece of medium sized luggage which can go in the boot and 1 hand luggage small enough to fit on the customer’s lap inside the cab. The customer must cover any extra costs to transport the extra luggage to the destination. Kindly note that no sort of luggage will be allowed on any of the passenger seats.   

Tips –

  • Tips are not included in any of the fares or quoted rates but are most welcome by the driver attending to the transfer.

Nothing contained in these terms & conditions can affect the customer’s statutory rights.
